actual port of discharge

Dear All,

May I have your opinion of the followings:

L/C terms request full set original marine B/L showing:
PORT OF DISCHARGE KICT/PICT PORT KARACHI

original B/L presented with the following discrepancy:

1. B/L SHOWING PORT OF DISCHARGE KICT/PICT PORT KARACHI
INSTEAD OF ONE ACTUAL PORT OF DISCHARGE
(EITHER KICT PORT KARACHI OR PICT PORT KARACHI)

For your information:
"(q) "Terminal Operator" includes Karachi International Container Terminal (KICT), Pakistan International Container Terminal (PICT) and Qasim International Container Terminal (QICT);";

I treat the B/L is discrepant.

However, one technical advisor told me that since both KICT OR PICT is situated at the same place "Karachi",
B/L is acceptable.

Please favour me your valuable comment on this case.

We should determine actual port of discharge from the docume

Dear Friend,

A B/L should indicate shipment from the port of loading to the port of discharge stated in the credit. We should determine from the document the actual port of discharge. If both KICT and PICT represent the same port, then I think no discrepancy..

in my opinion, it should be a discrepancy as for some large port, the code in fact matters. please consider ICC opinion TA594
The credit required the shipment to be effected to Alexandria (free zone). A free zone is a specific part of the port where import duties and associated costs are maintained at a level lower than the main port area. The fact that the bill of lading, in describing the goods that had been shipped, quoted the term "CFR Alexandria Free Zone" does not infer that the shipment was effected to the Free Zone area.The bill of lading is discrepant.

Dear shahrier,
the opinion that your refer is especially asked for specialized port where its really a matter. But in our case credit stipulated an alternative option by using Virgules which can be mean 'EITHER" or "OR" or both..... moreover according to ISBP Paragraph 2 it is the issuing bank and the applicant should bear the risk of ambiguity... From my point of view, mentioned port of discharge as karachi ONLY [WITHOUT STIPULATING ANY SPECIFIC PORT], or in COMBINATION OF BOTH ARE ACCEPTABLE. HENCE I WILL GO WITH NAVI.... NO DISCREPANT.

I agree with Shahriar, B/L should specify the specific port of discharge.

UCP and ISBP deal with Port of discharge and not a specific terminal within such a port.
