Hi friends,
we have l/c which defines port of loading as any port in China and description of goods as FOB named port of loading,
Presented documents show port of loading Shekou, invoice shows FOB Shekou, but B/L shows FOB Shenzen.
Would you consider it as discrepancy as B/L shows different deliviery term. I'm aware that Shekou is one port in Shenzen.
Nevertheless, ...
any opinions
regards
Mia

Hi Pal,

Observed few days ago,, same l/c, two presentations, two bills of lading issued by the same carrier, one showing Shekou and the other Shekou,Shenzenas POL. Advised applicant about the different name of the port in the second bill of lading, reason: issuing bank may be not aware of the names of ports serving the same area/city. The invoices were quoting FOB Shekou, l/c requires "Any China port"
IMHO, banking commission in Paris would consider this discrepancy not correct.
However, if you need a ground to stop l/c payment, this is possible!
Other comments appreciated
Ciao

Shenzen Port includes Shekou Port and any port of China includes Shenzen as well . Therefore FOB any port in China can be FOB SHENZEN or FOB Shekou.
As a simple remark, it is not uncommon for parties to quote a certain port of loading and a delivery terms to be for example ExW supplier factory. As such ,the buyer mandates the seller to handle some operations on buyer's account to the named port of loading on buyer's risks and expenses. (EXW to FOB). The UCP600 does not contain any prohibition in this respect. However if the BL does not show other place of receipt as a port within Shenzen, then consistent with Free on Board terms, it is understood that even though Shenzen includes many port/berths, FOB will mean FOB the port of loading named in the BL.
