typographical error of on board date on Cert. of Origin

typographical error of on board date on Cert. of Origin

Dear All,

May I ask your comment on the following case:

Quote

L/C terms:
46A: document required:
Cert. of Origin in duplicate.

47A:
Minor typographical error is acceptable.


Issuing bank cite the discrepancy of:

1. Cert. of Origin showing on board date 06/08/09 instead of 08/08/09
differ from B/L.

at the pre-print box “departure date”, Cert. of Origin showing 08/08/09
at the column of goods description, Cert. of Origin showing shipped on board Vessel XX on 06/08/09

Negotiating bank claimed that since typographical error is not treated as discrepancy.
L/C does not specifically request Cert. of Origin to show any detail such as shipment date, in the meantime, the departure date on Cert. of Origin is same as B/L. It is obviously the on board date is a typographical error.
Therefore, the discrepancy is invalid.

does it really matters what the certificate of origin says about 'on board' date. a certificate of origin may show even different references. i think its an additional information and should be disregarded.
