negotiability of B/L

Dear all,
Would anyone explain which type of B/L is negotiable and what are the characteristics of such
B/L?

dear babar,

this simple looking question could indeed have a very complex answer. the negotiability depends on several issue like governing rule, contract of carriage etc. in general BL issued "to oder" are negotiable where the carriage is entirely by Sea. if its a multimodal transport document, the the last leg must be by sea to be negotiable.

Dear Babar

I think the following definition may help you.

Definition of Negotiable B/L by Business Dictionary: B/L that can be transferred by its consignee to a third party by signing (endorsing) and delivering it to another party (the new consignee). The new consignee can then transfer it to another party ... and so on. To be negotiable a B/L must be written (drawn) 'To Order' of the consignee and must be clean. Any B/L that does not fulfill these two conditions is termed non-negotiable.

Negotiable b/l is the b/l that can be transfer the right of goods by shipper or consignor to another party by made consigned to order of shipper or to order of another party ,such as issuing bank,and endorsed by themselves.

as an addendum, negotiable b/l presuposes that an original must be presented to the carrier before goods or consignments can be delivered. however negotiability require that the b/l must be consign TO THE ORDER OF... a named party. ;)

i think it is not negotiable. this type of b/l has been used to delivery the goods for which payment has already been made. it is similar to cinsgnment bill of lading.

under some rules, even a to the order bill of lading is not considered as a title of goods. so we need the rule first.
