Packing List required to show any packing material

GOODS DESCRIPTION: TILES

DOCUMENTS REQUIRED:

1. SIGNED AND STAMPED PACKING LIST SHOWING PACKING MATERIAL SUCH AS WOOD,
PLASTIC, OR ANY OTHER PACKING MATERIAL USED.

BUT DOCUMENTS RECEIVED AS FOLLOWS:

SIGNED AND STAMPED PACKING LIST SHOWING
THERE IS NO PACKING MATERIAL SUCH AS WOOD,
PLASTIC, OR ANY TYPE OF PACKING MATERIAL USED.


NEGOTIATING BANK TREAT PACKING LIST IS ACCEPTABLE.
BUT L/C ISSUING BANK CLAIMED THAT
PACKING LIST NOT SHOWING ANY PACKING MATERIAL USED.

PLEASE LET ME HAVE YOUR COMMENT.
THANK YOU FOR YOUR ASSISTANCE.

UCP 600 ART. 14 F STATES:-
IF A CREDIT REQUIRES PRESENTATION OF A DOCUMENT OTHER THAN A TRANSPORT DOCUMENT, INSURANCE DOCUMENT OR COMMERCIAL INVOICE, WITHOUT STIPULATNG ......................... ITS DATA CONTENT, BANKS WILL ACCEPT THE DOCUMENT AS PRESENTED.............
SINCE THE DATA CONTENT STIPULATED IN THE CREDIT, NEGOTIATING BANK SHOULD NOT TREAT THE PACKING LIST AS ACCEPTABLE.
BETTER COMMENTS APPRECIABLE.

Hi Pals,

Packing list is a cargo description that is used to immediately find the goods you need first. Assuming you have 1000 box containing various shoes, discharged in your warehouse, and you have to forward, ladies shoes nos 36-39, black to a customer in ..... By consulting a packing list you will first open case no. 1, 7, 9 etc, but no the whole cargo.
Tiles, may be, have no packing, but gatheret on a pallets, wrapped in platic foils.
With weight list, you can arrange proper means of transport to move cargo from, for istance, a sea port to your warehouse. You cannot move marble blocks with Apecars.

I would like to have opinions. Does the clause really mean that there has to be a packing material? I feel that some may consider it as "if used". In that case negotiating bank may have a chance.

Presented packing list is discrepant. because it doesn't fulfill the condition as stipulated in credit. i.e packing material.

The term certainly ask for packing. If there was no packing, there was no point of asking packing list. For example do you ask for packing list for bulk cargo? Besides looking for packing material is sufficient to understand that the packing list requires to show packing material. The packing list is discrepant.

There is a clear requirement that Packing list to show that packing has been effected by some type of material. And as a matter of fact, tiles cannot be shipped in breakbulk. That's why applicant asked for such a type of packing

If credit requires only packing list in our above case [without mentioning the data content]
Does the present packing list discrepant?

Between the lines it can be understood that the issuer expects to the goods to be packed by some material, even it does not specify what material it is. Thereofore, no packing material, or no packing could be a discrepancy. :-\
