Signatures In Bill of Lading And Freight Invoice

Hello Team,

I hereby request your opinion on document checking.

LC calls for BL and freight invoice to be issued and signed by Owner or Master or Carrier or their agents.

Let’s say that:

Owner is ABC
Carrier is XYZ
Agent is PQR

The BL is issued and signed by the agent (PQR) for the carrier (XYZ). But no reference is made in the BL with regard to Owner.

On the other hand the document titled “freight invoice” is issued and signed by Owner (ABC).

Will the bank co-relate these two documents and pick up a discrepancy that there is no reference made in BL with regard to Owner?

In my opinion, it should not be a discrepancy as it has satisfied the LC terms.

Your opinion pls….

The L/C explicitly states the parties acceptable for signing the documents required. As the case is presented docs appear to be signed by one of these persons. There is no condition in the credit that the signor of a B/L should be the same on freight invoice if this was your concern

Hi!
According to UCP 600, BL can only be signed by
=>the carrier or a named agent for or on behalf of the carrier, or
=>the master or a named agent for or on behalf of the master.

**Any signature by the carrier, master or agent must be identified as that of the carrier, master or agent.
**Any signature by an agent must indicate whether the agent has signed for or on behalf of the carrier or for
or on behalf of the master.

So there is no option for the Owner.

Owner comes only for Charter Party BL.

So it is obvious that the LC requirement is not proper one.

No discrepancy, as LC clearly states that Owner or Master or Carrier or their agents can issue the Freight Invoice. Signatory need not be same as BL
