Hi

L/C calls for incoterm: CFR in field 45A
But transport document called is Airway bill.

Beneficiary presented docs as per L/C. invoice mentioned CFR and transport document presented AWB.

Do we need to pick discrepancy: "INVOICE SHOWING INCOTERM AS CFR WHEREAS AIRWAY BILL PRESENTED"

Pls provide your views.

Hi Pal,

Please ask issuing bank which article of UCP prohibits sending goods by air and quote CFR?

UCP and Incoterms are not linked in this way.
Applicant must word l/c requirement in the way that Incoterms are adjusted to the documents to be presented but
a bank cannot compare documents to be presented with other rules outside UCP.
I dont see an issue, naturally, by the details you quote in this forum.
Please let me know.

The applicant and beneficiary should carefully consider the documents required for presentation, by whom they are to be issued, their data content and the time frame in which they are to be presented."

so from my view point transport document requirement should match with the incoterm given in the LC and LC issuing officer should careful in this case.

INCOTERM RULE DEFINE CFR Delivery term meant for Sea or inland waterway transportation. However there is no restriction to use CFR only for sea or inland waterway transportation. It has been seen in number of cases FOB & CFR being used for Air transportation.

2. UCP & ISBP no where indicate CFR cannot be use for Air mode of transportation. LC is independ. Documents presented and comply with terms of LC is ok.
