Invoice Show Sample Goods With No Commercial Value

Dear fellows,
.
I had a situation. The LC amount USD 10.000 ask for Commercial invoice for Goods : Veneer, and the The Commercial invoice presented with goods amount USD 9,900
with an extra goods : Veneer Sample.
.
The veneer sample comes with unit price and amount USD 100.00 but stating " No commercial value"
and the amount of that veneer sample deduct the invoice value. (from 10,000 become 9,900)
.
Is it consider as discrepant, regarding to ISBP 745, C12.B
.
Your opinion would be highly appreciated.

Free of charge goods

dear,

as you said it is extra goods and it is stated it is free of charge or have no commercial value then according to c12b it is valid discrepant as the case would applies in the two situation when the extra goods of the same goods required under the credit or it is of different kind of goods the beneficiary in your case can stay away of such discrepant by giving $100 commercial discount instead of free goods not clearly called in the credit but I have one question does the credit state any number of quantity measurements ?

Hi Pals,

I have a note that sometime, depending on the specific request of the l/c, extra goods may be accepted.
See LCVIEWS forum post dated 07.03.2014.

According to ISBP C12b it is a definite discrepancy, look at the text as follow:

"An invoice is not to indicate: goods, services or performance not called for in the credit. This applies even when the invoice includes additional quantities of goods, services or performance as required by the credit or samples and advertising material and are stated to be free of charge."
