considering ISBP, paragraph D4, can a freight forwarder still issue BL without indicating the carrier

Hi,
Your question should refer to d3(b) instead of d4. When a credit indicates that Freight forwarder"s B/L is acceptable, then the B/L can be issued by the freight forwarder without indicating the name of carrier or its capacity of signing.

Hi simsun2516,

IMHO, it's obviously that the B/L should have to indicate the name of carrier. You may refer to Art. 14 (l) for further reference.

Provided the DC allows Freight Forwarder's transport document.

From D3, ISBP 745, IMHO Freight Forwarder' s Multimodal Transport Document can be issued without indicating a carrier, a capacity of the issuer or showing capacity as Freight Forwarder is the best. Pls refer to ICC opinion R734/TA727Rev

Hi,

In my opinion, it depends on the LC stipulations. If LC states that Freight Forwarder BL is acceptable, BL may be signed by any issuing entity, not necessarily indicating the carrier name. You should refer to ISBP 745, Para D3 (b) applied for MMTD or Para E3 (b) for BL or Para F2 (b) for Sea Waybill.

When LC states that Freight Forwarder BL is not allowed, it has no meaning that BL issued by Freight Forwarder is prohibited (refer to D4, E4 or F3 ISBP 745) In this case, BL will be examined according to Art 19, UCP 600, which means that it must clearly indicate the name of carrier. The format of this stipulation at the signature box is often " "Agent for X, the Carrier" or "Agent on behalf of X, the Carrier"
