UCP Art 20. transhipment? discrep

Post by vivian » Sun Apr 11, 2010 10:02 am

Hi , expert,

UCP 600, art 20, B/L indicating that transhipment will or may take place is acceptable. ........if the goods have been shipped ....evidence by B/L .

My question is : if a L/C say, transhipment: not allowed. B/L show that port of loading : shanghai, port of transhipment : Hong kong, port of discharge: London , but provided that this is a CONTAINER B/L.

Is this B/L acceptable?

My opinion is that, if the B/L is container B/L , transhipment not allowed is invalid. am I right ?

tks

Transhipment under UCP article 20

Agreed with you Vivian, under UCP 600 article 20 (c) -
If the credit prohibit transhipment, a bill of lading indicating that transhipment will take place is still to be acceptable provided that
1. the BL evidences that the relevant cargo has been shipped in a container, trailer or LASH barge, and
2. the entire ocean carriage is covered by one and the same BL.
