Within v From

Post by Judith » Tue Apr 06, 2010 3:04 pm

By virtue of Para 17 of ISBP, the term " Within " when used in connection with a date will exclude the date mentioned.
Eg. 1. Shipment within 05 Apr 10 - Shipment can be made any time till 04 Apr 10

By virtue of Art 3 "from" includes the date mentioned.
Eg.1. Shipment from 05 Apr 10 - Shipment can be made on 05 Apr 10 and anytime thereafter

Question: If shipment is to be made "within 2 days from 05 Apr 10", when can shipment be made?
a) On 04 Apr and 05 Apr OR
b) On 05-Apr and 06-Apr?

Appreciate your response...

Dear Judith,

As per article 3 of UCP - Interpretations - the words "to", "until", "till", "from" and " between" when used to determine a period of shipment include the date or dates mentioned.

In this case shipment on 05-April and 06-April is correct one.

Regards/Vijay
