Copie's of docs and dates determination

Post by Vital B. » Wed Mar 17, 2010 12:23 pm

Dear colleagues,
.
The next example: issued l/c indicates latest date of shipment 'xx.xx.xxxx', period of presentation: '15 days from the date of shipment' and requires the presentation of docs including copies (not originals) of transport documents.
.
Kindly advise whether should you treat the date indicated in the copy of transport document as date of shipment and whether it should be used for calculation of presentation period.
.
You answers are highly appreciated.

Date of shipment for copy of T/D

Post by Negotiator » Thu Mar 18, 2010 1:48 pm

Dear Vital B.

I believe that an answer for your question is clearly stated in Paragraph 20 of ISBP 681.

"whether should you treat the date indicated in the copy of transport document as date of shipment"
-> UCP Articles 19 through 25 shows how one can determine a date of shipment for each relevant transport docs. But Paragraph 20 of ISBP 681 says :

"Copies of transport documents are not transport documents for the purpose of UCP 600 articles 19-25 and sub-article 14(c). The UCP 600 transport articles apply where there are original transport documents presented. Where a credit allows for the presentation of a copy transport document rather than an original, the credit must explicitly state the details to be shown."

In the context of above paragraph, I think nobody can determine a date of shipment from a copy of transport doc itself unless the credit states how a date of shipment can be determined.

"whether it should be used for calculation of presentation period."
-> This query can also be solved by above paragraph. Copies of transport documents are not transport documents for the purpose of UCP 600 sub-article 14(c). Therefore, unless the credit states how a date of shipment can be determined, sub-article 14(c) of UCP 600 will have no meaning for this case and the documents may be presented at any time not later than the expiry date.

Regards.
