misspelling or?

Post by picant » Tue Jan 05, 2010 8:36 pm

Hi Pals,

Here is a real case on an l/c:

Bill of lading indicates Container no. xxxx0900530/ seal 0080530, where a packing list shows Container no. xxxx0900530/ seal 0080350, misspelling or discrepancy?

Your help appreciated.

Thanks

Ciao

mispelling

Dear Picant,
Seal Number problem: conflicted vs misspelling [assuming that seal no. is not a requirement of credit]
.
The litmus test for judging data conflict issue is based on sub article 14(d) : expressly:
d. Data in a document, when read in context with the credit, the document itself and international standard banking practice, need not be identical to, but must not conflict with, data in that document, any other stipulated document or the credit.
.
This is solely my analysis and i have no approve view.
Here the word " Relationship between Data" should consider carefully:it may be:
Let assume:
Data between documents required by the credit = Internal
Data between documents not required by the credit = external
.
if conflict arises internal Vs internal = data conflicted and thereby discrepant.
if conflict arises internal VS external = same
If conflict arises External Vs. External = should treat as additional information and thereby disregard it.
.
Pls ignore it, if not logical,
.
However, I would not consider it as discrepancy,,,, Probably Official Opinion R559 helpful.
regards
nesar

misspeling but numbers different from words

Post by edilee » Wed Jan 06, 2010 12:25 am

it seems misspelling
but when the spelling is on the numbers it is a bit different because
machine i/o mashine is not discrepancy it is a misspelling
but model 123 is not same as model 132 it is a discrepancy
moreover my personel idea in that case it is not a discrepancy if it is not contrast with our docs.
as nesarul indicated

ICC opinion R559

Post by shahriar » Wed Jan 06, 2010 11:44 am

dear picant,

you may consider ICC opinion R559 here.
The credit did not require the invoice to quote the container number. Nevertheless, the invoice quoted the number but misquoted one of the figures, which was clearly a typographical error. Other key data was consistent.

In the context of this particular query, there is no discrepancy.

Typing error

Post by Hussam » Wed Jan 06, 2010 3:33 pm

Dear all
I will take it as a typing error rather than a misspelling and accept doc
Noting that the error is in the seal number not in, say the quantity of goods

Regards
