CMR Goods Have Been Received For Shipment

Dear all,
I am earnestly request for your comment on the following case.

Lc terms:
CMR made out to order of banco popular portugal, sa

L/c issuing claim that:
CMR not indicate that the goods have been received for shipment

Negotiating bank response as the followings:

I treat the cmr is acceptable in this case.
