Can First Beneficiary Present Documents To Make Presentation Comply With LC Terms?

Post by dinesh2476 » Tue Apr 18, 2017 5:27 pm

Dear Experts,

Can first beneficiary present documents to make presentation comply with LC terms?

transferred LC calls for certificate of origin and analysis which is not presented along with presentation which makes documents discrepant. Just to make the presentation comply, can the second beneficiary present these documents on their letter head to make these presentation complying.

From the issuing bank point of view, presentation is complying according to the original LC.

to my knowledge, First beneficiary cannot present these documents without performing just to make presentation comply.
second beneficiary is only has the right to present these documents, refusal notice must be sent to the second beneficiary to present these documents.

Need experts opinion.

Regards
Dinesh
