BL Signed By The Agent Without Mentioning Carrier

Post by TradeLaporte » Tue Mar 21, 2017 9:13 pm

Hi! Fellows
BL is signed : ABC as agent only
Did not indicate for the carrier
BL showing name of carrier on the header of document.
Can we call it as a valid discrepancy?

Signature on BL

Hi !
UCP 600 sub-article (a) states as follows---
'' a. A bill of lading, however named, must appear to:
i. indicate the name of the carrier and be signed by:
- the carrier or a named agent for or on behalf of the carrier, or
- the master or a named agent for or on behalf of the master.
Any signature by the carrier, master or agent must be identified as that of the carrier, master or agent.
Any signature by an agent must indicate whether the agent has signed for or on behalf of the carrier or for
or on behalf of the master.''

Again ISBP 745 paragraph E5)c states as---
""c. When an agent signs a bill of lading for [or on behalf of] the carrier, the agent is to be named and, in addition, to indicate that it is signing as "agent for (name), the carrier" or as "agent on behalf of (name), the carrier" or words of similar effect. When the carrier is identified elsewhere in the document as the "carrier", the named agent
may sign, for example, as "agent for [or on behalf of] the carrier" without naming the carrier again."

So, if the signatory of the BL is a named agent and the carrier is identified elsewhere in the document as the "carrier", then there is no discrepancy.

Regards,
Shafique

hi,

I consider it as a discrepancy as it is not specified on whose behalf the agent has signed the BL
as per UCP 600 sub-article (a): Any signature by an agent must indicate whether the agent has signed for or on behalf of the carrier or for or on behalf of the master.'
