Multimodal Bill Of Lading Is Subject To The Charter Party?

Post by dieselica » Tue Apr 28, 2015 6:04 pm

Hello everyone!

It would be very helpful if you could give me some feedback regarding the following:

1) Is it possible that multimodal bill of lading is subject to the charter party?
If it's not, could you please explain why?
If is, then:

1a) LC is issued indicating in swf 46a a multimodal bill of lading as one of the required documents. In swf 47a it is stated that charter party multimodal bill of lading is acceptable.
Upon presentation, should this transport document be checked under UCP600 art. 19 or art. 22?

1b) LC is issued indicating in swf 46a a multimodal bill of lading as one of the required documents. In swf 47a it is stated that charter party bill of lading is acceptable.
Upon presentation, should this transport document be checked under UCP600 art. 19, art. 20 or art. 22?

1c) LC is issued indicating in swf 46a a multimodal bill of lading as one of the required documents. There's nothing stated in LC in regards to charter party being acceptable.
Upon presentation, should this transport document be checked under UCP600 art. 19 or art. 22?

Thanks!

Dear dieselica,

Charter party bill of lading is a type of bill of lading used under sea mode of transport.

IMHO, If Charter Party Bill of Lading is acceptable under LC and u receive Charter Party B/l you have to check it under article 22. There is question how to identify whether it is charter party B/l or not? Any indication made to it that it is Charter party B/L or have marking freight prepaid or payable as per charter party automatically makes it subject to charter party. If u receive multimodal B/L you have to check it under article 19.

If there is nothing written regarding charter Party B/L in LC, so bene should present Multimodal B/L as required and should be checked under article 19.

Gega.

Hi Pal,

Charter party bill of lading refers to a ship hired, chartered, so the other transport legs are not included.
Only carrier may arrange a complete transport of the goods.

Other comments appreciated
