New Discrepancies in a Re-presentation

Post by SREEJA » Tue Jan 20, 2015 10:28 pm

An issuing bank refuses documents citing some discrepancies. The beneficiary corrects the discrepancies and resubmits within validity. Can the issuing bank now point our fresh discrepancies that already existed in the first presentation but the issuing bank failed to point out?

Discrepancies arising out of the fresh documents presented can be pointed out , not discrepancies pertaining to the original documents presented.

An Issuing bank can refuse the documents only once. Upon receipt of revised documents from the beneficiary, disc can be raised based on the revised presentation not on the original presentation.
