Suppose lc has amended today and beneficiary has send document which is complied to lc before amendment.shipment has been done before amendmend date whether any discrepancy due amendment is applicable

Dear,

Issuing bank point of view:

Hope you would agree that ...whether the amendment accepted or rejected will be determined based on the presentation of documents. Having said that , if the presentation complies with LC (without considering the changes in the amendment) the documents seems to be clean. we cannot raise discrepancy on such event.

Presenting bank/Nominated/confirming bank point of view:
if the bank receives amendment on the day of presentation of documents. considering the relation ship with the presenter(incase of beneficiar not as bank) bank may contact beneficiary immediately and update them that the changes in the amendment. But it is own discretion of the bank to contact them. They may act as the instruction previously received from presenter.

UCP600 Article 10
c. The terms and conditions of the original credit (or a credit incorporating previously accepted amendments) will remain in force for the beneficiary until the beneficiary communicates its acceptance of the amendment to the bank that advised such amendment. The beneficiary should give notification of acceptance or rejection of an amendment. If the beneficiary fails to give such notification, a presentation that complies with the credit and to any not yet accepted amendment will be deemed to be notification of acceptance by the beneficiary of such amendment. As of that moment the credit will be amended.
Thus if the presentation complies with the original LC, there is no option to raise discrepancy based on the amendment

How ben will give reply by swift or mail or their is any provision in ucpdc that we should wait for min __days

In this case no way to provide discrepancy.
Refer to UCP-600 article 10(c)
If presented doc complies with LC but not with amendment.Then the LC deemed to be not amended.So u can't rise any discrepancy against this doc.Even the doc presented after amendment but beneficiary not communicate about the acceptance of the amendment & present the doc as per LC, u can't rise any discrepancy.

Whether we should mention in amendment that"if this amendment is not refused/accepted within--days it will treated as accepted amendment"

in my opinion if you received the amendment after all documents have been issued (not necessary presented to the bank yet) and documents contain the date of issuance, you may disregard the amendment.

Eventhough, beneficiary received the amendment on the date of presentation, he has the option to abide the amendment or not.
