Post by TradeLaporte » Fri Aug 08, 2014 1:30 am

Dear members
Issuing Bank claiming discrepancy on a port to port BL because on board notation does not contain a date. Do you consider valid Discrepancy if yes what section of art 20 will apply . Thanks for your comments

ISBP 745 Section E6 B
(a) when a bill of lading is per-printed “shipped on board”,the date of issue will
be deemed to be the date of shipment, and no further on board notation is required.

If date of issue is appearing on the b/l or

E6
E6) a. When a Pre-printed“Shipped on board” bill of lading is presented, its issuance
date will be deemed to be the date of shipment unless it bears a separate dated on
board notation. In the latter event, such date will be deemed to be the date of
shipment whether that date is before or after the issuance date of the bill of lading.
The on board date may also be indicated in a designated field or box.

On board

Hi Pals,

if the bill of lading is RECEIVED FOR SHIPMENT the on board notation must be dated.
I dare say that if a SHIPPED ON BOARD Bill of lading is noted with ON BOARD(not dated) may be accepted as the notation is immaterial, see (6) bill of lading flowchart in document no 470/1128rev final 22 April 2010

BL date

Post by TITI » Thu Aug 14, 2014 9:15 am

Hi,
As Per UCP 600 art 20.a.ii,
indicate that the goods have been shipped on board a named vessel at port of loading stated in the credit by:
- pre rpinted wording, or
- an on board notation indicating the date on which the goods have been shipped on board
The date of issuance of the bill of lading will be deemed to be the date of shipment unless the bill of lading contains an on board notation indicating the date of shipment, in which cated the date stated in the on board notation will be deemed to be the date of shipment.
.
if the BL only stating"Received", it means that BL have to mention the on board date. But if the BL showing preprinted "Shipped", the dateof issuance of the bill of lading will be deemed to be the date of shipment
.
regards
Titi
