Wrong LC Number Shown As Shipping Mark

Post by diana59 » Fri Jun 07, 2013 2:56 pm

L/C:
shipping marks not specifically required to be stated in documents

Documents:
invoice and packing list show within marks: "L/C No. A123B" while
Bill of Lading shows within marks: "L/C No. A1231B".

L/C No. is otherwise correctly vritten on all documents.

Is this discrepancy (I think no) and which article of UCP or ISBP explain this.

Many thanks for your reply.

shipping marks

Para 34 of ISBP states that "The purpose of a shipping mark is to enable identification of a box, bag or package. If a credit specifies the details of a shipping mark, the documents mentioning the marks must show these details, but additional information is acceptable provided it is not in conflict with the credit terms". So, whilst an addition may be made there must not be any data inconsistency.

Clearly, the LC number is incorrectly stated and would not fall within the acceptance tolerance of typos. In fact, for mistyping of reference numbers, there is no tolerance. It would also be difficult to argue for acceptance on the basis that information in the shipping marks do not affect the operation of the LC and therefore may be disregarded. The data consistency principle would unfortunately extend to even the shipping marks.

Misquoting of LC no. is not a discrepancy. there is a ICC opinion for typo error on LC no.
